Mandatory Legal Disclaimer: Vespera Is Not a Law Firm
Vespera provides self-guided technology worksheets, financial alignment exercises, and structured drafting briefs for prospective spouses and their attorneys. Vespera is not a law firm, does not employ attorneys to represent users, and does not provide legal advice, legal opinions, or attorney representation. No attorney-client relationship is formed through your use of Vespera.
Enforceable prenuptial agreements strictly require independent legal counsel and statutory financial disclosures under state law. You must review any exported brief or agreement with your own independent attorney.
1. Acceptance of Terms
By accessing or using the Vespera website (located at withvespera.com) or any associated software and services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Nature of the Service
Vespera is a self-directed intake platform designed to help prospective spouses:
- Organize premarital assets, liabilities, and separate property.
- Privately evaluate marital scenario choices using a blind-then-reveal workflow.
- Identify areas of consensus and divergence before meeting with independent lawyers.
- Export structured term sheets and disclosure packets to provide to their independent attorneys.
Vespera does not draft binding contracts, file court documents, evaluate the legal validity or enforceability of any arrangement, or advise you regarding your statutory marital rights under state law.
3. Independent Legal Counsel Required
Most jurisdictions (including California, New York, Texas, and states adopting the Uniform Premarital and Marital Agreements Act) require both prospective spouses to be represented by separate, independent legal counsel to ensure premarital agreements are binding and enforceable. You expressly acknowledge that Vespera is not a substitute for an attorney and that you are solely responsible for retaining qualified legal counsel in your jurisdiction.
4. Accuracy of Financial Disclosures
The validity of marital agreements hinges upon full, fair, and accurate disclosure of all assets, debts, and income. You are solely responsible for the truthfulness, completeness, and accuracy of any values, schedules, or records entered into the Service. Vespera does not verify, audit, or certify your disclosures.
5. Fees and Payments
Certain advanced modules, full questionnaire catalogs, and lawyer export briefs require payment of a one-time fee per couple. All prices are displayed in U.S. dollars. There are no recurring subscriptions or automatic renewals. All purchases are final and non-refundable once digital brief files are exported, except as required by law.
6. Intellectual Property
The design, software, decision models, interactive tools, illustrations, and copywriting on Vespera are the intellectual property of Vespera. You retain ownership of your personal financial records, questionnaire responses, and private notes. You receive a limited license to export and share your personal drafting brief with your legal counsel.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESPERA AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF ASSETS, UNENFORCEABILITY OF LEGAL AGREEMENTS, LITIGATION EXPENSES, OR LEGAL FEES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
